1. Acceptance of Terms

By accessing or using Sovereign Messenger ("the Service", "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Sovereign Messenger. We may update these Terms at any time, and your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

Sovereign Messenger is a decentralized, peer-to-peer messaging application built on the Solana blockchain that provides:

• End-to-end encrypted wallet-to-wallet messaging
• On-chain message storage and delivery
• Premium subscription features
• Reputation and identity management system
• User moderation tools (block, report, hide)

3. Eligibility

To use Sovereign Messenger, you must:

• Be at least 13 years old (or 16 in the EU)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Own or control a Solana-compatible cryptocurrency wallet
• Comply with all applicable laws and regulations in your jurisdiction

4. Account Responsibilities

4.1 Wallet Security

• You are solely responsible for maintaining the security of your wallet private keys.
• We cannot recover lost private keys or reverse blockchain transactions.
• You must immediately notify us of any unauthorized use of your account.
• You accept all risks associated with wallet-based authentication.

4.2 Account Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to other users' accounts
• Use bots, scripts, or automated tools to interact with the Service
• Harvest or collect information about other users

5. User Content and Conduct

5.1 Content Ownership

You retain ownership of all content you create, send, or post through the Service. By using the Service, you grant us a limited license to transmit and display your content as necessary to provide the Service.

5.2 Prohibited Content

You agree not to send, post, or share content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Promotes violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Contains child sexual abuse material (CSAM) or exploits minors
• Infringes on intellectual property rights of others
• Contains malware, viruses, or malicious code
• Promotes fraudulent schemes, scams, or illegal activities
• Contains pornography or sexually explicit material
• Violates the privacy or publicity rights of others
• Constitutes spam or unsolicited commercial messages

5.3 Content Moderation

• Users can block, report, and hide content from other users.
• We reserve the right to investigate reported content and take appropriate action.
• We may remove access to accounts that violate these Terms.
• Blockchain content cannot be deleted, but we can prevent access through our interface.

6. Premium Services and Payments

6.1 Subscription Plans

• 30-Day Premium: 0.089 SOL for 30 days of premium features
• Lifetime Premium: One-time payment for lifetime access
• Seeker NFT Holders: Automatic premium access with eligible NFTs

6.2 Payment Terms

• All payments are processed through the Solana blockchain.
• Payments are non-refundable except where required by law.
• Cryptocurrency prices may fluctuate; USD values are estimates.
• You are responsible for all blockchain transaction fees.
• Premium subscriptions do not auto-renew; you must manually renew.

6.3 Changes to Pricing

We reserve the right to change pricing at any time. Changes will not affect existing active subscriptions but will apply to future purchases.

7. Intellectual Property

7.1 Our Rights

Sovereign Messenger, its logo, and all related content are protected by copyright, trademark, and other intellectual property laws. You may not use our branding without express written permission.

7.2 Open Source

Portions of Sovereign Messenger may be open-source software subject to separate license terms. Please refer to our GitHub repository for details.

8. Privacy and Data

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

Key privacy points:

• Messages are end-to-end encrypted
• We cannot read your message content
• Blockchain data is public and permanent
• Local data is stored on your device only

9. Disclaimers and Limitations of Liability

9.1 Service Provided "AS IS"

Sovereign Messenger is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Accuracy or reliability of information
• Security of data transmission

9.2 Blockchain Risks

You acknowledge and accept the risks associated with blockchain technology, including:

• Irreversible transactions
• Volatility of cryptocurrency values
• Potential smart contract vulnerabilities
• Network congestion and variable transaction fees
• Loss of private keys resulting in permanent loss of access

9.3 Limitation of Liability

To the maximum extent permitted by law, Sovereign Messenger and its operators shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from third-party conduct or content
• Unauthorized access to or alteration of your transmissions or data
• Loss of cryptocurrency or NFTs due to user error or wallet compromise

In jurisdictions that do not allow the exclusion or limitation of liability, our liability shall be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sovereign Messenger, its operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your use or misuse of the Service
• Your content or conduct on the Service

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

11.2 Arbitration

We reserve the right to suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Illegal or fraudulent activity
• Creating risk or legal exposure for us or other users
• Extended periods of inactivity

12.3 Effect of Termination

• Your right to use the Service immediately ceases
• We may delete your local profile and cached data
• Blockchain data remains permanent and accessible
• Provisions regarding liability, indemnification, and dispute resolution survive termination

13. Third-Party Services

The Service integrates with third-party services including:

• Solana blockchain network
• Wallet providers (Phantom, Solflare, Backpack)
• RPC providers (Helius, Solana Foundation)

We are not responsible for the availability, accuracy, or reliability of third-party services. Your use of these services is governed by their own terms and policies.

14. Changes to Service

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service
• Change features, functionality, or availability
• Impose limits on usage or features
• Update these Terms at any time

We will notify users of material changes through the Service or other reasonable means.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sovereign Messenger regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We are not liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including blockchain network issues, acts of God, or government actions.
